These courses are defined in the Provisions of the Real Estate License Act (TRELA), Chapter 1101, Texas Occupations Code Section 1101.003, and the Rules of the Texas Real Estate Commission, Section 535.69.

Principles of Real Estate, Law of Agency, and Law of Contracts are required courses.

Principles of Real Estate -
  Shall include but not be limited to an overview of licensing as a real estate broker and salesperson, ethics of practice, titles to and conveyances of real estate, legal descriptions, deeds encumbrances and liens, distinctions between personal and real property, appraisal, finance and regulations, closing procedures, real estate mathematics , and at least three classroom hours of instruction on federal, state, and local laws relating to housing discrimination, housing credit discrimination, and community reinvestment.

Law of Agency -
  Shall include but not be limited to the principal-agent and master- servant relationships, the authority of an agent, the termination of an agent's authority, the fiduciary and other duties of an agent, employment law, deceptive trade practices, listing or buying representation procedures, and the disclosure of agency.

Law of Contracts -
  Shall include but not be limited to the elements of a contract, offer and acceptance, the statute of frauds, specific performance and remedies for breach, unauthorized practice of law, commission rules relating to use of adopted forms, and owner disclosure requirements

Real Estate Appraisal -
  Shall include but not be limited to the central purposes and functions of an appraisal, social and economic determinant of value, appraisal case studies, cost, market data and income approaches to value estimates, final correlations, and reporting.

Real Estate Law -
  Shall include but not be limited to legal concepts of real estate, land description, real property rights and estates in land, contracts, conveyances, encumbrances, foreclosures, recording procedures, and evidence of titles.


Real Estate Finance -
  Shall include but not be limited to monetary systems, primary and secondary money markets, sources of mortgage loans, federal government programs, loan applications, processes and procedures, closing costs, alternative financial instruments, equal credit opportunity acts, community reinvestment act, and state housing agency.

Real Estate Marketing -
  Shall include but not be limited to real estate professionalism and ethics, characteristics of successful salesperson, time management, psychology of marketing, listing procedures, advertising, negotiating and closing, financing, and the Deceptive Trade Practices-Consumer Protection Act, as amended, Section 17.01 et seq., Business & Commerce Code.

Real Estate Mathematics -
  Shall include but not be limited to basic arithmetic skills and review of mathematical logic, percentages, interest, time-valued money, depreciation, amortization, proration, and estimation of closing statements.

Real Estate Brokerage -
  Shall include but not be limited to law of agency, planning and organization, operational policies and procedures, recruiting, selection and training of personnel, records and control, and real estate firm analysis and expansion criteria.

Property Management -
  Shall include but not be limited to role of property manager, landlord policies, operational guidelines, leases, lease negotiations, tenant relations, maintenance, reports, habitability laws, and the Fair Housing Act.

Real Estate Investments -
  Shall include but not be limited to real estate investments characteristics, techniques of investment analysis, time-valued money, discounted and non-discounted investment criteria, leverage, tax shelters, depreciation, and applications to property tax.

Promulgated Contract Forms -
  Shall include but not be limited to the unauthorized practice of law, broker-lawyer committee, current promulgated forms, commission rules governing use of forms, and case studies involving the use of forms.

Residential Inspection for Real Estate Agents -
  Shall include but not be limited to property condition addendum, inspector and client agreement, tools and procedures, electro-mechanical system (plumbing, heating, air conditioning, appliances, energy saving considerations), and structures (lot and landscape, roofs, chimney, gutters, paved areas, walls, windows and doors, insect damage and storage areas

Pre-License Education Requirements -
Salesperson & Broker Applicants

Salesperson -
To be eligible to apply for a salesperson license, an individual must have completed 150 classroom hours of core real estate courses and 60 related (or other core real estate) hours for a total of 210 classroom hours. Individual Broker -
To be eligible to apply for a broker license, an individual must have completed 270 classroom hours of core real estate courses and 630 related hours. Education Courses & Providers for Salesperson & Broker Applicants -

  • Real Estate Related Courses considered acceptable by the Commission for real estate related credit, provided they are taken from an approved source.


1. Education Requirement

The following education is required for a salesperson license:

1.Principles of Real Estate core real estate course [60 classroom hours]
2.Law of Agency core real estate course (30 classroom hours)
3.Law of Contracts core real estate course (30 classroom hours)
4.An additional core real estate course (30 classroom hours)
5.Another four semester (60 classroom) hours in core courses or in related courses acceptable to the Commission. A bachelor's degree or highter from an accredited college or university satisfies all of the "related" education requirements for a salespersons license. A copy of the college transcript awarding the degree must be submitted as evidence of completion of the degree.
6.Effective 09/1/2010 a pre-application education evaluation is no longer available prior to submitting an application. Real estate applicants are no longer required to submit an education evaluation request and receive a notice from the commission that the education requirements have been satisfied prior to submitting an application for a license. The education evaluation request form is eliminated and education course completion documents must be submitted when the application is filed.

2.Filing Your Application
After you have completed your education, you may file and pay for the Application for Inactive Salesperson License. Evidence of successful completion of your education via credit transcript or certificate should be submitted with your application. DO NOT submit original transcripts or course completion documents. Keep the originals for your personal files and send photocopies to the Commission.

Please apply and pay online for your Inactive Salesperson License. The information requested online is the same as on the paper application. If you are filing online, scan and send your education documents electronically to education@trec.state.tx.us or fax them to 512-465-3989 with a copy of your completed application. If submitting your application by mail or in person, please note that an application received without the appropriate fees will be rejected and your check will be returned to you. The following fees should be submitted in ONE CHECK OR MONEY ORDER payable to the Texas Real Estate Commission.
ALL FEES LISTED BELOW ARE NONREFUNDABLE.

3.Examination Information

License examinations are administered by PSI, a testing service company. Once your application has been received, processed and accepted, you will receive notification that you may obtain a copy of the Candidate Information Brochure (CIB) to register for the exam. The CIB will provide instructions on how to make reservations to take the examination and contains study material and instructions about licensing. A copy of the CIB can be downloaded from the PSI web site. Please DO NOT attempt to register for the exam without first receiving notification from our office.

The examination must be passed within six months from the date the application is filed with the commission office.

4.Investigation May be Needed
The filing of an application authorizes an investigation of the applicant's background. Information revealed in an investigation may be cause for disapproval of an application even though other requirements for a license are met. If an investigation is necessary, it may not be conducted until the applicant has passed the examination.

5.Texas Guaranteed Student Loan Repayment History Checked
State law prohibits the renewal of a license if a licensee has defaulted on a student loan guaranteed by TGTM unless the licensee has entered into a repayment agreement with TG. YOU SHOULD CONTACT TG BEFORE FILING THIS APPLICATION if you have defaulted on a student loan. An application or renewal may be rejected if this agency has received information from TGSLC that the applicant has defaulted on a student loan. 6.Obtain Sponsorship
Before you can practice as a licensed salesperson you must arrange for a Texas real estate broker holding an active license to sponsor you as a salesperson. Applicants and inactive salespersons are not authorized to act as real estate agents.

While you are not required to have a sponsoring broker to file an application for a license, a Salesperon Sponsorship Form is included with the application materials. If you wish, you may file the sponsorship request along with the application. Once all licensing requirements have been satisfied, TREC will send an active salesperson license to the broker, and you may act for the broker on receipt of the license.

You may also file the application and arrange for sponsorship after TREC notifies you that you have been issued an inactive license. Once a broker holding an active license has mailed a request to TREC to act as your sponsor, you may begin to act for the broker as a salesperson.

7.Don't Practice Prior to Licensure
You are not authorized to perform any act for which a real estate license is required until an ACTIVE Texas Real Estate Commission license is in the possession of your sponsoring broker.

As noted above in the Filing Your Application section, online applications travel through the system much faster than paper-based applications. The online application process could potentially save you weeks of waiting for a license, due to the delays of regular mail communication and other factors inherent in the paper-based process (such as data entry time and processing of checks).
