New Rules Regarding Online License Renewal:
Salespersons under SAE requirements must submit their education hours to TREC at least 10 business days in advance of renewing their license online.
Salesperson Application Requirements
To file a Texas real estate salesperson application on or after January 1, 2006, applicants must have completed 150 classroom hours of core real estate courses and 60 related (or core hours) for a total of 210 classroom hours. (7 courses). This is an increase of 30 core hours over the education requirement prior to January 1, 2006.
SAE Requirements
** 60 HOURS for 1St RENEWAL
A salesperson who files an application on or after January 1, 2006 will be required to have a total of *270 classroom hours by the end of their 1st year of licensure. Once the 270 hours are completed they will have satisfied the SAE requirements and will fall under Mandatory Continuing Education (MCE) requirements. **60 hour SAE courses are only available through Correspondence at this time. (Quicker completion)
*The 270 classroom hours are composed of the following: 210 hours for pre-licensure requirements - including 60 hours in Principles of Real Estate; 30 hours of Law of Agency; 30 hours in Law of Contracts; 30 additional core hours; and 60 related or core hours. New Laws Strengthen Real Estate License Holders’ Accessibility and Accountability to Consumers
New laws effective in 2011 and 2012 are good news for both consumers and licensees.
September 9, 2011
Beginning in January 2012, applicants for a broker license will need to have four years of experience as a licensed salesperson, up from the current two year requirement, plus demonstrate practical competency by providing a detailed list of brokerage activities engaged in by the applicant during this same period. This will ensure consumers who deal with brokers and their sponsored salespersons a level of service more solidly backed up by additional practical experience.
Brokers, and other direct supervisors of licensed salespersons, who seek to renew a license after September 1, 2012 will need to have completed a new 6 hour course in “Broker Responsibilities”, in addition to the combined 6-hour courses in Legal and Ethics updates. All of these courses are updated every two years by a panel of experts convened by the Real Estate Center at Texas A&M University. Applicants for a sales license after September 1, 2012 will need to have completed two additional mandatory 30-hour courses in TREC Promulgated Contracts and in Real Estate Finance, courses that are currently optional. This additional education will directly benefit consumers.
Among the more notable changes, as of September 1st, property managers for single-family residential units must now be licensed. Persons involved in leasing such properties have always been required to hold a real estate broker or sales license, but managers not engaged in leasing did not.
The updated law also acknowledges the practice of producing “broker price opinions” as a common broker activity, and more clearly distinguishes these from “appraisals”, which require a separate and distinct appraiser license from the Board, and requiring extensive education in valuation techniques. Homeowners, lenders and practitioners will all benefit from this overdue clarification.

TREC HOUSEKEEPING BILL UPDATE
April 2011
With the 82nd Session of the Texas Legislature more than halfway through, the TREC housekeeping bill continues through the legislative process in both the Senate and the House. Senate Bill 747 and its companion, House Bill 1637, amend The Real Estate License Act (the Act) to provide additional education, experience and accountability standards for TREC licensees, as well as several cleanup provisions.
Education Improvement Measures Pre-license education requirements for a salesperson license would change from 210 total to 180 core hours . Related education requirements would no longer be required but the education requirements for the first renewal of a salesperson license would increase from 60 to 90 core hours. The total number of hours needed for the first renewal of a salesperson license would remain at 270 hours. The first time examination pass rate benchmark for pre-license education programs would change from 55% to an average percentage of examinees.

TREC Advisor Update
Background Check Fee for Renewals
All licensees who have been fingerprinted for TREC will eventually have to pay an additional fee for a subsequent background criminal history report when renewing their licenses. Licensees who were fingerprinted for a 2008 renewal, application or late renewal, and whose current license expiration is March 31, 2009 or thereafter, must pay the renewal fee and an additional fee (currently $19.25 ) for a subsequent background criminal history report to renew the license. Renewal fees will be returned to licensees who submit incorrect fee amounts and the license will expire if the correct amount is not timely received.
Fingerprint Requirements (and FAST Print Pass)
A recently enacted law (HB 1530, 80th Legislature, regular session) requires any person applying for or renewing a broker or salesperson license on or after January 1, 2008 to provide their fingerprints, in a specified format, in order to enable an FBI criminal background check to be performed.

"24 hour MCE Rule"
As of Sept 1, 2007, a licensee who takes an online MCE (Mandatory Continuing Education) course will not be allowed to complete an online course in less than 24 hours. If a licensee has paid their renewal fee and begins an online MCE course for renewal purposes on the day their license expires, credit will not be awarded for completing the course on that day (regardless of how many hours credit the course is). If this occurs, the licensee's MCE will be considered late and a $200 Late MCE penalty fee will be assessed.
